Privacy Policy for Application Management System | contorion.de
1. General
This applicant management and tracking system is operated by Contorion GmbH, Friedrichstraße 224, 10969 Berlin, Registernummer HRB 157922 B (Amtsgericht Charlottenburg) betrieben. Contorion GmbH can be held liable in terms of section 11 of the Federal Data Protection Act. We provide you with this privacy policy in order to inform you about how we handle your personal data obtained through the online application process.
By sending your application, you agree with this privacy policy, especially (i.) with the transfer of your data to third parties like our service providers (Details: No. 6 of this Privacy Policy), (ii.) with the processing, especially storaging, of your data in our internal candidate's database called „Talentpool“ (Details: No. 4.2 of this Privacy Policy) and (iii.) to receive information about other job opportunities at Contorion GmbH (Details: No. 4.3 of this Privacy Policy). You can revoke your consent at anytime via [email protected].
2. Personal data obtained during the online application process
Personal data is information relating to an identified or identifiable natural person. This may include information such as your name, address, telephone number and date of birth, as well as details about your career etc., which can be assigned to a specific person without a disproportionate effort. Information that cannot directly be associated with your real identity is not considered personal data. Under certain circumstances, some special categories of personal data, such as health records, origin and religion, might be included in this if you provide us with these.
3. The collection and processing of personal data
Our privacy policy conforms with the Federal Data Protection Act and the German tele-media act. If you apply for a vacant position or submit a speculative application through the application system on our website, you provide personal data and information (first name, surname, email address, telephone number, and any attachments such as your CV and cover letter) voluntarily.
The provided data is transferred through TLS encryption and is saved in a database which our company takes responsibility for and which is operated by our contractor Personio GmbH (personio.de), Buttermelcherstr. 16, 80469 Munich, Germany. We have entered into an order data processing contract in accordance with section 11 of the Federal Data Protection Act with Personio GmbH, which provides their human resources management and applicant tracking solution to us and saves the data exclusively on ISO 27001-certified servers in Germany. This ensures that your personal data is only processed in conformity with our instructions and that consistent high standards apply concerning data security. br> If you send a speculative application directly via email to [email protected], your data will usually be transferred unencrypted. br> Employees responsible for filling vacant positions have access to this database.
4. Process, especially storage of personal data, e.g. „Talentpool“ and „Interesting Positions“
4.1 The storage of personal data only takes place for the purpose of
- filling the vacant position which you applied for and/ or
- filling other (relevant) open positions in Contorion GmbH and/ or
- listing you in our Talentpool to contact you if we may have an interesting position for you in Contorion GmbH.
4.2 „Listing in our Talentpool“ means that we will (i.) process, especially store, your personal data within (ii.) our internal, confidential candidate´s database for (iii.) a period of maximum 24 month or, if earlier, until you revoke your consent, to (iv.) provide you with other potentially suitable job positions at Contorion GmbH. You can revoke your consent at anytime via [email protected]. If you do not consent/ revoke your consent, your data will not be processed, especially stored, within our database and you will not receive other job positions.
4.3 „Contact you for interesting positions“ means that we will provide you (i.) from time to time, but regularly not more than once a week, (ii.) via various communication channels, but usually via e-mail or phone, with (iii.) interesting open job positions – (vi.) from Contorion GmbH. You can revoke your consent at anytime via [email protected]. If you do not consent/ revoke your consent, your data will not be processed, especially stored, within our database and you will not receive other job positions.
5. Deletion of personal data
In accordance with section 35(2)(2) of the Federal Data Protection Act, we have to delete your data if we use your personal data for our own purposes and your awareness is no longer necessary for the pursuance of the purpose. If you have consented to be listed in our „Talentpool“, we will store your data for a period of maximum 24 month or, if earlier, until you revoke your consent. If you do not consent to be listed in our „Talentpool“/ if you revoke your consent, we will delete/ anonymize your data latest 6 months after the end of our application process.
However, you can contact us anytime via [email protected] to (i.) revoke your consent and/ or (ii.) ask for your data to be deleted.
6. Transfer of personal data
6.1 As described, we will pass on your personal data (i.) to our contractor Personio GmbH (No. 3 of this Privacy Policy), if you have given us/ not revoked your consent to do so. You can revoke your consent at anytime via [email protected]. If you do not consent to transfer your data to Personio GmbH/ if you revoke your consent, we will not do so but then, consequently, have to stop and end your application process.
6.2 Besides that, we can only pass on your personal data without your permission, apart from in the circumstances mentioned in this privacy policy, in the following circumstances:
If it is required for prosecution, personal data can be forwarded to law enforcement agencies and if necessary affected third parties. In this case, there must be concrete evidence of unlawful or abusive behaviour. Transfers may also be made for the enforcement of terms of use or other agreements.
We are also legally obliged to provide information at the request of public authorities such as law enforcement agencies, financial authorities and governmental authorities who pursue administrative offences that entail a fine.
7. Safety of your personal data
We as a company, employees who are involved in the application process and third-party companies, such as Personio GmbH, are directed to take appropriate technical and organisational measures to protect your personal data from abuse, unauthorised publishing and loss. These measures meet at least the requirements of section 9 of the Federal Data Protection Act.
8. Right to information
You have the right to ask for disclosure of your stored data (section 34 of the Federal Data Protection Act). You also have the right to ask us to correct, delete or block your data in accordance with section 35 of the Federal Data Protection Act. 10. Validity and changes of the privacy policy for the application management system
The privacy policy is dated September 25th, 2017. Due to future development of our application process or due to the implementation of new functions or technologies, it may become necessary to alter the privacy policy in the future. We reserve the right to make relevant alterations at any time.
